These Terms & Conditions (“Terms”) govern your use of the website thegoldenmemories.com and any enquiry, quotation, itinerary, reservation or travel service arranged through The Golden Memories (“The Golden Memories”, “we”, “us” or “our”). By submitting a booking request, approving a quotation, making any payment, or using a confirmed travel service, you acknowledge that you have read and accepted these Terms.

1. Scope and Our Role

The Golden Memories operates as a tour operator and travel service arranger. Depending on the booking, we may directly provide certain services (for example, a private sightseeing tour, local itinerary coordination or a vehicle/guide arrangement) and may also facilitate or arrange services supplied by independent third parties.

Independent third-party suppliers may include, without limitation:

  • airlines, airports and other carriers;
  • hotels, resorts, homestays and other accommodation providers;
  • local transport operators, vehicle owners, drivers and fleet partners;
  • local guides, destination management companies and overseas ground handlers;
  • restaurants, cruise operators, activity providers and event operators;
  • monument, attraction, wildlife, forest, safari, permit and ticketing authorities;
  • visa, immigration, embassy/consular, insurance and documentation service providers; and
  • payment gateways, banks and other payment service providers.
Third-party services

Where a service is supplied by an independent third party, The Golden Memories acts as an arranger/facilitator for that component unless our written confirmation expressly states that we are the direct service provider. The supplier remains responsible for the actual performance, safety, schedules, inventory, rules, facilities, refunds and service standards of its own service.

 

2. Definitions

Booking: a reservation or service confirmed by us after the applicable payment and/or supplier confirmation requirements are satisfied.

Traveller / Customer / You: the person making the booking and every person travelling under that booking, as applicable.

Supplier: an independent third party providing any component of the travel arrangement.

Travel Service: a tour, itinerary, transport, hotel, flight, activity, ticket, permit, guide service or other travel-related component arranged or provided through us.

Booking Confirmation: our written confirmation, voucher, invoice, itinerary or other document confirming the services purchased and their material terms.

3. Website Enquiries Are Not Automatically Confirmed Bookings

Submitting a website form, WhatsApp message, email or telephone enquiry does not by itself create a confirmed booking. A booking is confirmed only when we issue a written confirmation or voucher after receiving any required advance/full payment and, where relevant, obtaining supplier availability or confirmation.

Availability and prices may change between enquiry and confirmation. We are not responsible for inventory being sold out, fares changing, hotel rates changing, permits closing or supplier availability changing before confirmation.

4. Quotations, Prices and Taxes

  • Prices displayed on the website may be “from” prices, indicative prices or prices based on stated assumptions such as minimum persons, travel dates, room category or vehicle type.
  • Your final payable amount is the amount stated in the written quotation, invoice or booking confirmation accepted by you.
  • Prices may change before confirmation due to supplier repricing, exchange-rate movements, tax changes, fuel surcharges, permit fees, peak-season supplements or changes requested by the customer.
  • Once a booking is confirmed, any later increase will be handled according to the applicable supplier terms, written booking terms and mandatory law.
  • Unless specifically stated as included, personal expenses, tips, shopping, optional activities, meals, baggage fees, visa fees, insurance, monument/attraction tickets and other incidental costs are excluded.

5. Booking, Payment and Confirmation

Payment instructions, due dates, advance requirements and balance-payment dates will be communicated in the quotation, invoice or booking confirmation. Failure to pay within the stated period may result in release of held inventory or cancellation of unconfirmed services.

Payment through a bank, UPI, card or payment gateway is also subject to the terms and technical processing of that provider. A payment being debited does not necessarily mean a supplier service is confirmed; if supplier confirmation fails, we will handle the amount in accordance with the Refund & Cancellation Policy.

6. Customer Information and Accuracy

You are responsible for providing complete and accurate traveller names, ages, dates, passport details, contact information and other information required for the booking. Names for flights, visas, permits and other regulated services should match the relevant identity/travel document exactly.

Costs or losses caused by incorrect information supplied by the customer – including airline name-correction charges, reissuance fees, rejected permits or booking changes – are the customer’s responsibility unless the error was caused by us.

7. Inclusions, Exclusions and Itinerary

Only items expressly stated as included in the final itinerary, voucher or booking confirmation form part of the confirmed package. Photographs, examples, suggested restaurants, sample schedules and destination descriptions are illustrative unless specifically confirmed as an inclusion.

Reasonable itinerary sequencing may change because of traffic, local closures, weather, operating hours, security instructions, religious or public events, supplier timing, guest convenience or other operational reasons. Where the essential nature of a service is materially changed by us, we will provide reasonable assistance or alternatives subject to availability.

8. Specific Booking Terms Override General Terms

Certain tours or quotations may state specific conditions such as “free cancellation up to 24 hours in advance”, “non-refundable”, “minimum two persons”, “pay later”, special peak-season conditions or supplier-specific deadlines. Those specific written terms govern the affected booking.

9. Flights and Airline Services

When we arrange or assist with flights, the airline is the carrier and is responsible for operating the flight. Airline fare rules govern ticket validity, change/cancellation fees, baggage, seating, check-in deadlines, schedule changes, delays, cancellations, denied boarding, upgrades/downgrades, refunds and other carrier-controlled matters.

  • We do not control airline schedules, operational disruptions, airport processes, baggage handling or airline refund timelines.
  • Any amount recoverable for an airline cancellation/change is subject to the airline’s fare rules and actual refund/credit released by the airline, except where mandatory law provides otherwise.
  • Any Golden Memories service/consultation/convenience fee that was clearly disclosed as non-refundable remains governed by the written booking terms, to the extent permitted by law.
  • We will provide reasonable assistance in communicating with the airline or processing a permitted change/refund, but assistance does not make us the carrier or transfer the airline’s obligations to us.

10. Hotels and Accommodation

Hotels and accommodation providers are independent suppliers responsible for their rooms, facilities, cleanliness, service, meals, amenities, maintenance, staff, safety procedures, check-in/check-out, deposits, incidental charges and property rules.

  • Hotel star/category descriptions may differ by country or local classification standards.
  • Room allocation, floor, bed configuration, view, early check-in and late check-out are subject to hotel availability unless expressly guaranteed in writing.
  • Hotel cancellations, no-shows, early check-outs, date changes and refunds are governed by the rate plan and hotel/supplier terms provided for the booking.
  • If a hotel changes inventory, overbooks, closes facilities or otherwise fails to perform, we will reasonably assist with the supplier or an alternative, but the underlying hotel service remains the hotel’s responsibility.

11. Ground Transport, Drivers and Guides

Vehicle model/category, driver, guide or route may be substituted with a reasonably comparable option when required by availability, maintenance, safety, traffic regulation or operational circumstances. Travel times are estimates and may be affected by road conditions, weather, traffic, checkpoints, local restrictions and events.

Customers must comply with lawful driver/guide instructions, vehicle capacity and safety rules. Excess baggage, unusual equipment, child-seat needs, accessibility requirements or special mobility requirements should be disclosed before confirmation.

12. Attractions, Wildlife Safaris, Activities and Permits

Entry tickets, safari slots, forest permits, monument tickets, cruises, adventure/water activities and other limited-capacity services may be controlled by government bodies or independent operators. Their availability, identity/document requirements, reporting time, age/health restrictions, weather rules and cancellation terms apply.

Wildlife sightings are never guaranteed. Weather, conservation restrictions, forest closures, safety decisions or authority orders may alter or cancel a safari/activity. Where a third-party activity is affected, any refund, reschedule or credit is subject to the applicable operator/authority policy and recoverability.

13. Passports, Visas, Immigration and Travel Documents

Each traveller is responsible for holding a valid passport, visa, permit, health/travel document and any destination/transit authorization required for the complete journey. Visa assistance provided by us is administrative assistance only; visa approval, duration, conditions and immigration entry remain exclusively with the relevant government/consular authorities.

We are not liable for refusal, delay, cancellation of visa, denied entry, deportation or loss caused by incomplete/inaccurate information supplied by a traveller or a decision of an authority, except to the extent a loss is directly caused by our own proven error in a service we agreed to provide.

14. Travel Insurance, Health and Special Requirements

Travel insurance is not included unless expressly stated. We strongly recommend suitable insurance covering cancellation, medical treatment, evacuation, baggage, delays, personal liability and supplier failure, particularly for international, adventure and wildlife travel.

Travellers are responsible for assessing their fitness for travel and disclosing material mobility, medical, dietary or assistance requirements relevant to the service. We will try to accommodate disclosed requirements but cannot guarantee facilities controlled by independent suppliers.

15. Customer-Requested Changes

Date, route, hotel, flight, passenger, room, vehicle, activity or itinerary changes requested after confirmation are subject to availability and may attract supplier charges, fare differences, taxes and our disclosed amendment/service fee. A requested change is not effective until confirmed in writing.

16. Cancellation, No-Show and Partial Use

Cancellation and refund rights are governed by the Refund & Cancellation Policy, the specific tour/quotation terms, and any applicable supplier rules. Failure to arrive, late arrival causing a missed service, voluntary early departure or partial use of a confirmed service may be treated as a no-show or unused service and may be non-refundable.

17. Supplier Changes, Delays and Service Failures

We are not liable for acts, omissions, insolvency, overbooking, delays, schedule changes, strikes, cancellations, accidents, service deficiencies or other failures of independent suppliers merely because we arranged their service. Where an issue occurs, we will provide reasonable coordination and support and will pass through any remedy, refund, credit or alternative that the supplier makes available, subject to the booking terms and applicable law.

What this clause does not exclude

Nothing in these Terms removes responsibility that The Golden Memories cannot lawfully exclude, including responsibility for our own fraud, wilful misconduct, or any other liability that mandatory consumer or other applicable law requires us to bear.

 

18. Force Majeure and Events Beyond Reasonable Control

Neither party will be treated as breaching the contract for failure caused by events reasonably beyond its control, including severe weather, natural disasters, epidemics/pandemics, war, terrorism, civil unrest, governmental orders, border closures, strikes, transport shutdowns, airport closures, forest/monument closures, fire, flood or comparable events.

In such situations, we may alter sequencing, offer a reasonable alternative, reschedule, issue a recoverable credit, or process a refund to the extent amounts are actually refundable/recoverable from the affected suppliers. Non-recoverable third-party charges remain subject to the supplier terms and mandatory law.

19. Traveller Conduct

Travellers must behave lawfully and respectfully and must not endanger themselves, staff, guides, drivers, suppliers or other persons. We or a supplier may refuse or discontinue service where conduct is abusive, illegal, unsafe, intoxicated to a dangerous extent, or materially disruptive. Any additional costs resulting from such conduct are the traveller’s responsibility, subject to applicable law.

20. Website Content and Availability

We try to keep website descriptions, prices, photographs and destination information accurate, but travel information changes frequently. Operating hours, entry charges, routes, seasonal conditions, hotel facilities and supplier services may change after publication. The final written booking confirmation should be relied on for your purchased inclusions and price.

21. Intellectual Property

Website text, layout, branding, graphics, photographs owned or licensed by us and other original website content are protected by applicable intellectual-property laws. You may use the website for personal travel-planning purposes but may not reproduce, scrape, republish, commercially exploit or misrepresent our content without permission, except where law allows.

22. Limitation of Liability

To the maximum extent permitted by applicable law, The Golden Memories is responsible only for direct loss that is proven to have resulted from our own breach, negligence or failure in a service that we directly undertook to provide. We are not responsible for indirect, consequential or purely speculative loss, loss of enjoyment, business loss, or losses arising from a third party’s independent act or omission, except where such exclusion is prohibited by law.

Where the law permits a contractual cap, our aggregate liability for a claim relating to a particular booking will not exceed the amount actually paid to The Golden Memories for the affected Golden Memories-provided service, excluding pass-through supplier amounts, unless mandatory law requires otherwise.

23. Complaints and Assistance During Travel

If a problem arises during travel, please contact us as soon as reasonably possible so that we have an opportunity to assist while the service is ongoing. For supplier issues, customers should also report the issue immediately to the hotel, airline, driver, activity operator or other supplier and retain relevant receipts, photographs and written communications.

Post-travel complaints should be sent to info@thegoldenmemories.com with the booking reference, traveller name, dates and supporting evidence. We will review complaints relating to our services and coordinate with suppliers where the complaint concerns a supplier-controlled component.

24. Privacy

Personal information is handled in accordance with our Privacy Policy. By requesting or booking travel, you understand that relevant traveller information may need to be shared with suppliers and authorities to arrange the requested services.

25. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. The parties should first attempt to resolve any dispute through good-faith communication with our grievance/customer-support contact. Subject to any mandatory rights to approach a consumer commission, regulator or other forum, courts of competent jurisdiction at Jaipur, Rajasthan will have jurisdiction over disputes connected with these Terms or a booking.

26. Severability, Waiver and Updates

If any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible. A failure to enforce a provision once is not a permanent waiver. We may update these Terms for future use of the website or future bookings; the version applicable to an existing booking is the version incorporated into or available at the time of confirmation, except where a legal change must apply.
